Wheels for Scholarships Raffle Terms and
Conditions: This raffle ticket is offered by Rome Catholic School
(GC 30-101-440-01859), a New York State not-for-profit
organization and Carbone Auto Group is delivering the Ford Mustang
subject to these Terms and Conditions. Ticket price is $10.00.
Your payment may be made by credit card (your statement will read
“Rome Catholic School”), cash or check payable to Rome Catholic
School. All entries must be received prior to 1 p.m., May 16th
by Rome Catholic School. The drawing will be held at 2 p.m. on
Sunday, May 16th at Rome Catholic School. Ticket
holder need not be present to win. The winner will be selected at
random from eligible entries and will be notified by certified
mail to the address given on the ticket stub within 10 calendar
days of the drawing. The winner must present this ticket and
identification to claim the prize and has until 5:00 p.m. on the
10th calendar day after the postmark of the mailed
notice to do so. If the prize is not claimed by that deadline,
the next drawing ticket may be awarded the prize, subject to
presentation of that ticket and identification by 5:00 p.m. on the
10th calendar day beginning with the calendar day after
the postmark of the mailed notice to that next selected winner.
After presenting the ticket, the winner has 10 calendar days to
accept delivery of the Ford Mustang. Rome Catholic School may in
its sole discretion extend the deadline to accept the delivery of
the Ford Mustang (or Rome Catholic School may select another
winner as prescribed above), but any extension is only valid if (i)
Rome Catholic School executes an extension in writing and (ii) the
winner can demonstrate good cause why he or she is not able to
accept the delivery of the Ford Mustang. The winner’s legal
relationship with Carbone Auto Group, including but not limited to
responsibility for any liability issues and warranty issues, will
be governed by any contracts to be signed by the winner and
Carbone Auto Group. Requests, made by mail to purchase tickets for the Ford Mustang,
must be received by May 16th at 1 p.m. and will be
processed in the order in which they are received. After the
drawing, to receive the number of the winning ticket, please send
a self-addressed stamped envelope to Rome Catholic School, 800
Cypress Street, Rome, NY 13440 with your request. By entering the
Wheels for Scholarships Raffle, the winner agrees to have their
name, photograph and ticket number publicized. The winner of the
Wheels for Scholarships Raffle is responsible for all applicable
taxes including but not limited to any sales tax and income
taxes. The winner is responsible for all registrations, licensing
and any other requirements related to the ownership and operation
of the Ford Mustang. Rome Catholic School will receive any
proceeds remaining after paying Carbone Auto Group for the Ford
Mustang. The maximum number of tickets sold will be 10,000 and the
odds of winning will be determined by the number of entries
received by Rome Catholic School. A minimum of 3,500 tickets must
be sold to award the Ford Mustang to the winner. If less then
3,500 tickets are sold, all cash proceeds, less expenses incurred
by Rome Catholic School to administer the raffle, will be awarded
to the winner. Entrants must be at least 18 years of age. Rome
Catholic School administrators and owners of Carbone Auto Group
and the spouses, children, siblings, parents and grandparents of
the Carbone Auto Group owners are not eligible to win. Tickets
cannot be transferred.
IN PROVIDING THE FORD MUSTANG AS A PRIZE,
ROME CATHOLIC SCHOOL DOES NOT ACCEPT ANY LIABILITIES FOR ANY
INJURIES OR DAMAGES ARISING OUT OF ANY DEFECTS IN THE FORD MUSTANG
OR ARISING OUT OF THE USE OR OWNERSHIP OF THE FORD MUSTANG. THE
FORD MUSTANG IS PROVIDED AS IS, AS AVAILABLE AND WITH ALL FAULTS.
ROME CATHOLIC SCHOOL DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED
WARRANTY OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS
FOR A PARTICULAR PURPOSE. ROME CATHOLIC SCHOOL IS NOT RESPONSIBLE
FOR AND DISCLAIMS ANY AND ALL LIABILITY FOR ANY SERVICES OR
PRODUCTS PROVIDED BY CARBONE AUTO GROUP OR ANY THIRD-PARTY
PROVIDERS. ROME CATHOLIC SCHOOL IS NOT LIABLE TO WINNER OR ANY
TICKET HOLDER FOR ANY INDIRECT DAMAGES, LOST PROFITS, INCIDENTAL
DAMAGES, PUNITIVE DAMAGES, CONSEQUENTIAL DAMAGES OR DIRECT DAMAGES
IN CONNECTION WITH ANY MATTER ARISING OUT OF OR RELATED TO THE
FORD MUSTANG OR THE WHEELS FOR SCHOLARSHIPS RAFFLE.
